1. Agreement

These Terms & Conditions (“Terms”) govern your use of the Site and your relationship with Bankers To Brokers (“we”, “us”, “our”). By accessing or using the Site, you agree to be bound by these Terms.

2. Services

We provide mortgage brokerage and advisory services in the Greater Toronto Area including finding lenders, negotiating mortgage terms, and guiding you through application and closing. Our services do not guarantee approval of any mortgage or offer.

3. Eligibility

By using our services or submitting information to us, you represent that you are at least 18 years of age and legally able to enter into a binding contract.

4. Use of Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You will not submit false or misleading information or attempt to interfere with Site operation.

5. Mortgage Application and Disclaimer

Our role is to act as a mortgage broker. We gather information and propose suitable lenders and terms based on your profile. All loan applications are subject to lender approval, underwriting, and other conditions beyond our control. We make no warranty that your mortgage application will be accepted.

6. Fees and Compensation

We are compensated by lenders or by separate agreement. You may request details of any compensation we receive. Unless otherwise agreed in writing, you are not required to pay us fees directly for our brokerage services.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images and software, is our property or licensed to us and is protected by Canadian and international intellectual-property laws. You may not reproduce or distribute any portion of the Site without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, our liability to you for any loss or damage arising out of your use of the Site or our services is limited to the lesser of: (a) the fees you paid us in relation to the specific service, or (b) a nominal amount of CAD $100. We are not liable for indirect, incidental or consequential damages, including lost profits.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, damages, costs or expenses (including reasonable legal fees) arising out of your breach of these Terms or your use of the Site.

10. Links to Third-Party Websites

The Site may contain links to external websites. We do not control and are not responsible for the content or practices of those websites. Your use of them is at your own risk.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes will be subject to the exclusive jurisdiction of the courts of Ontario.

12. Amendments

We may modify these Terms at any time by posting revised Terms on the Site. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.
